The short answer, is yes – and no. Due to the US Federal system of government, the states have the power to make their own laws. Currently, around 30 US states allow sports betting, and 19 US states currently allow online sports betting. The states that allow sportsbooks to operate have benefitted from taxing gambling.

The legalization of US sportsbooks took off in 2018 when the United States Supreme Court overturned the Professional and Amateur Sports Protection Act. This Act had previously made gambling illegal in all states except Nevada (Las Vegas) and a few other states.

Since 2018, online Sportsbooks in the US have seen a massive industry boom as it experiences rapid growth and expansion. Each year, more states legalize online gambling, with states like Maryland, Nebraska, Ohio, and Wisconsin with plans currently in motion to legalize sportsbooks.

Can I Legally Use Online Sportsbooks in the US if My State Hasn’t Legalized Online Gambling Yet?

In short, yes. Let’s assume that the person asking the question is from Texas — a state that hasn’t made solid plans to legalize online sportsbooks as of right now. However, Colorado is a one-day road trip away, and online gambling is legal in Colorado. So, can our Texans legally gamble online in Colorado?
